Terms & Conditions

1. Definitions

   The following definitions apply to the Lake Homes Offer Over Campaign Terms & Conditions (the T&Cs):

   • 21 Day Disclosure Document means the disclosure document that provides general information about living in a residential park and contains information about the proposed Site Agreement.
   • 21 Day Disclosure Period has the meaning given in clause 7(b).
   • Acceptable Offer means the highest Offer placed by an Eligible Participant for the Participating Lake Homes nominated on the Lake Homes Offer Over Campaign Form, submitted before the conclusion of the Lake Homes Offers Over Campaign Period, that exceeds the Guide Price.
   • Business Days means any day that is not a Saturday, Sunday or public holiday in Queensland.
   • Conditional Contract means a contract entered into between the Successful Participant and Serenitas whereby the Successful Participant agrees to enter into a Sales Contract and Site Agreement at a future date, before the Settlement Date.
   • Contact Information means the phone number and email address provided by the participant to Serenitas on the Lake Homes Offer Over Campaign Form. Each participant is solely responsible for providing their correct Contact Information to Serenitas. Failure to provide correct Contact Information will disqualify you from being classified as an Eligible Participant.
   • Lake Homes Offers Over Campaign means the Serenitas campaign addressed by these T&Cs.
   • Lake Homes Offers Over Campaign Form means the form made available to an Eligible Participant inviting the Eligible Participant to place an Offer for a Participating Lake Home, completed in accordance with clause 5.
   • Lake Homes Offers Over Campaign Period has the meaning given in clause 3.
   • Dispute means a dispute or difference of opinion between the parties regarding these T&Cs.
   • Dispute Notice means a notice issued by either Serenitas or an Eligible Participant in the Lake Homes Offers Over Campaign, notifying the other of a Dispute.
   • Eligibility Criteria means the conditions in clause 4 that must be met before an Eligible Participant will be entitled to participate in the Lake Homes Offers Over Campaign.
   • Eligible Participant means a person or couple that:
     1. is not an Excluded Participant.
   • Excluded Participant means a person who is disqualified from being an Eligible Participant by Serenitas because the person:
     • provided false or misleading information to Serenitas;
     • breached any of these T&Cs; or
     • contravened any applicable law or regulations or otherwise engaged in unlawful or improper conduct in relation to their engagement or dealings with Serenitas.
   • Expression of Interest Process means the process for placing an Offer as outlined in clause 5.
   • Guide Price means the minimum amount for an Offer to be considered by Serenitas as an Acceptable Offer for a Participating Lake Home, as communicated by Serenitas in the Lake Homes Offers Over Campaign Form.
   • Offer means an offer made by an Eligible Participant for a Participating Lake Home as nominated by Serenitas on the Lake Homes Offers Over Campaign Form.
   • Participating Lake Home means the Lake Homes available in the lots at the Site, as nominated by Serenitas on the Lake Homes Offers Over Campaign Form, that an Eligible Participant is entitled to make an Offer on.
   • Sales Contract means the contract entered between an Eligible Participant who makes an Acceptable Offer and Serenitas that details the terms of the purchase of a Participating Lake Home.
   • Serenitas means Serenitas Development Trust II (ABN 60 851 767 232) of Level 36, Suite 03, 60 Margaret St, Sydney NSW 2000.
   • Serenitas’ Customer Database means the internal Serenitas customer relationship management database containing the names and contact information of individuals who have opted in, and which Serenitas has collected data from in accordance with, the Serenitas Privacy Policies, and collected across any Serenitas lifestyle resort, such as the Lakeview Springs Lifestyle Resort.
   • Serenitas Privacy Policies means the:
     1. Lakeview Springs Lifestyle Resort Privacy Policy last updated in July 2025, available here: https://lakeviewsprings.com.au/privacy/; and
     2. The Serenitas Privacy Policy, last updated in September 2024, available here: https://serenitas.com.au/privacy-policy/
   • Settlement Date means 20 October 2025 for Lot 35, 20 October 2025 for Lot 36, 31 October 2025 for Lot 37 or 31 October 2025 for Lot 38 at the Site.
   • Site means the Lakeview Springs Lifestyle Resort located at 77 Spring Way, Nikenbah QLD 4655.
   • Site Agreement means the agreement between a Successful Participant and Serenitas under the Manufactured Homes (Residential Parks) Act 2003 (Cth).
   • Successful Participant means the Eligible Participant who made the Acceptable Offer for the respective Lot 35, Lot 36, Lot 37 or Lot 38 at the Site.
   • Lakeview Springs Lifestyle Resort Office Hours means Monday to Saturday, 10:00 am – 4:00 pm (AEST).
2. Information forming part of T&Cs
   1. Information published or distributed by Serenitas on how to participate in the Lake Homes Offers Over Campaign form part of these T&Cs.
   2. By participating in the Lake Homes Offers Over Campaign, Eligible Participants accept and agree to be bound by these T&Cs.
   3. These T&Cs and any related information or document captured by clause 2(a) do not form a binding contract between an Eligible Participant and Serenitas. No binding contract will be formed until clauses 6 and 7 are satisfied.
3. Lake Homes Offers Over Campaign Period
   1. The period during which an Eligible Participant may be eligible to participate in the Lake Homes Offers Over Campaign commences at 9:00 AM (AEST) on Wednesday the 20th of August 2025 and concludes at 4:59 pm (AEST) on Wednesday the 3rd September 2025 (the Lake Homes Offers Over Campaign Period).
   2. During the Lake Homes Offers Over Campaign Period, Eligible Participants may complete and submit a Lake Homes Offers Over Campaign Form in accordance with clause 5 during Lakeview Springs Lifestyle Resort Office Hours.
4. Eligibility Criteria

   To be eligible to participate in the Lake Homes Offers Over Campaign:

   1. the person participating in the Lake Homes Offers Over Campaign must be an Eligible Participant;
   2. the person must comply with these T&Cs at all times; and
   3. the person must comply with the Expression of Interest Process in clause 5.
5. Expression of Interest Process
   1. To participate in the Lake Homes Offers Over Campaign, Eligible Participants must:
      1. complete and submit the Lake Homes Offers Over Campaign Form during the Lake Homes Offers Over Campaign Period, at the Eligible Participant’s election, by either:
         1. emailing it to info@lakeviewsprings.com.au; or
         2. physically delivering the Lake Homes Offers Over Campaign Form to the sales office located at the Site during Lakeview Springs Lifestyle Resort Office Hours;
      2. provide their Contact Information on the Lake Homes Offer Over Campaign Form;
      3. select their preferred Participating Lake Home on the Lake Homes Offers Over Campaign Form, by ticking the correlating box; and
      4. place an Offer on their preferred Participating Lake Home in accordance with the Guide Price,
      (collectively, the Expression of Interest Process).
   2. For the avoidance of doubt, Eligible Participants are entitled to place an Offer on multiple Participating Lake Homes by completing and submitting a separate Lake Homes Offers Over Campaign Form for each Participating Lake Home in accordance with this clause 5.
   3. Eligible Participants can place a maximum of one Offer per Participating Lake Home. After an Eligible Participant has placed an Offer for a Participating Lake Home in accordance with clause 5, the Eligible Participant will be unable to resubmit any further Offer and the Offer on the Eligible Participant’s Lake Homes Offers Over Campaign Form will be the Offer considered by Serenitas for the purposes of clause 6(a).
   4. At the conclusion of the Lake Homes Offers Over Campaign Period, Serenitas will email all persons within Serenitas’ Customer Database, advising that the Lake Homes Offers Over Campaign Period has concluded and that no further Offers can be made. Any offer made after the conclusion of the Lake Homes Offers Over Campaign Period will be invalid and not capable of being the Acceptable Offer.
   5. For the avoidance of doubt, the Guide Price applies only to the Participating Lake Homes at the Site and does not apply to any other or future Serenitas resort.
6. Acceptable Offer
   1. After the conclusion of the Lake Homes Offers Over Campaign Period, Serenitas will review all completed and submitted Lake Homes Offers Over Campaign Forms made before the conclusion of the Lake Homes Offers Over Campaign Period, and offer the Participating Lake Home selected to Successful Participants who made an Acceptable Offer.
   2. All Successful Participants will be notified by Serenitas via phone call and/or email, using their Contact Information, on the outcome of their Offer and whether it was an Acceptable Offer or not by 5:00 pm AEST on Wednesday the 10th September 2025.
   3. If, at the conclusion of the Lake Homes Offers Over Campaign, two or more Eligible Participants have made the same Acceptable Offer, the Eligible Participant who first joined the Lakeview Springs database will be the Successful Participant.
7. Acceptance of Participating Lake Home allocation
   1. Should the Successful Participant wish to accept the allocation of the Participating Lake Home in accordance with clause 6, the Successful Participant must, within 7 days of being notified in accordance with clause 6(b):
      1. provide written acceptance of the allocation to Serenitas confirming the allocation; and
      2. make a deposit of AUD$5,000 to Serenitas’ nominated bank account.
   2. Upon receipt of the written acceptance and further deposit in accordance with clause 7(a), Serenitas will issue the Successful Participant with:
      1. a Sales Contract; and
      2. the 21 Day Disclosure Document,
      which the Successful Participant will have 21-days to consider (the 21 Day Disclosure Period).
   3. By the end of the 21 Day Disclosure Period, the Successful Participant must either confirm they will not proceed with the purchase of the allocated Participating Lake Home, or else confirm they wish to proceed by:
      1. payment of the initial deposit amount of AUD$15,000 to Serenitas’s nominated bank account; and
      2. signature of a Conditional Contract for the allocated Participating Lake Home.
   4. Settlement for the allocated Participating Lake Home must occur on the Settlement Date.
   5. For the avoidance of doubt, if the Successful Participant fails to pay the final deposit in accordance with clause 7(c)(1) or else Settlement does not occur by the date in clause 7(d), Serenitas reserves the right to, at its election, allocate the Participating Lake Home to another Eligible Participant or market the home to the wider public.
8. Limitation of liability

   To the maximum extent permitted by law, and subject to clause 9, Serenitas and its related entities, employees, agents, contractors and sales consultants will not be liable for and will not accept responsibility for:

   1. any indirect or consequential loss;
   2. any communication or lack of communication with a person outside of Serenitas’ control including where this is as a result of any of the following (and provided that Serenitas did not cause the relevant event):
      1. telecommunications problem or outage;
      2. technical issues;
      3. security breaches; or
      4. the person’s failure to provide correct Contact Information to Serenitas that results in misdirected or incorrect communications (among others);
   3. any loss, cost or expense incurred as a result of Serenitas’ use of the Contact Information in accordance with clause 11;
   4. any error on behalf of a person (other than Serenitas) participating in the Lake Homes Offers Over Campaign that results in any loss, cost or expense, including human error resulting in a Lake Homes Offers Over Campaign Form or Offer not being sent to Serenitas;
   5. any loss, cost or expense either arising or incurred by way of a third party’s engagement by a person (other than Serenitas) in connection with the participation in the Lake Homes Offers Over Campaign, including but not limited to, financial advice or legal advice; and
   6. any loss, cost or expense incurred in connection with the variation, suspension, or termination of these T&Cs or the person’s participation in the Lake Homes Offers Overs Campaign in accordance with clause 12.
9. Liability cap

   To the maximum extent permitted by law, each party's total liability to the other for any claims arising from or related to these T&Cs shall not exceed $500.

10. Warranty
    1. To the maximum extent permitted by law, Serenitas and its related entities, employees, agents, contractors and sales consultants make no warranty or representation as to the accuracy or sufficiency of any description, illustration, photograph or statement contained in any advertisement relating to the Lake Homes Offers Over Campaign, or any information or statements made or given by its related entities, employees, sales consultants, agents or contractors concerning the Lake Homes Offers Over Campaign.
    2. To the maximum extent permitted by law, Serenitas will not be liable for any loss, damage or expense suffered or incurred by any person who relies upon the information identified in clause 9(a) in any such Lake Homes Offers Over Campaign advertisement, publication or statement.
11. Use of Contact Information

    By agreeing to these T&Cs, you consent to Serenitas collecting and using your Contact Information in accordance with the Serenitas Privacy Policies to:

    1. undertake future marketing and conducting future sales promotions (which may include disclosure to third parties for the purposes of processing and conducting the sales promotions) and for sales promotion purposes, public statements and advertisements in relation to the sales promotions;
    2. provide information to you about the products and services offered by Serenitas and its related companies; and
    3. undertake research to improve its products and services.
12. Suspension, termination and variation

    Serenitas may vary these T&Cs and extend, suspend, terminate or otherwise vary the Lake Homes Offers Over Campaign at any time without notice, except for material changes or changes that may have a detrimental impact on you, in respect of which Serenitas will provide you with notice as reasonably practicable in the circumstances.

13. Dispute resolution
    1. Neither Serenitas nor an Eligible Participant may commence court proceedings or initiate any form of dispute resolution process in relation to these T&Cs against the other party until this clause 13 has been followed by the party initiating proceedings or process.
    2. A Dispute arises where either Serenitas or an Eligible Participant provides a Dispute Notice to the other.
    3. Within 10 Business Days of receipt of the Dispute Notice, the parties must meet and use their best endeavours to resolve the Dispute through good faith discussions.
    4. If the parties are unable to resolve the Dispute pursuant to clause 13(c), at any time either party may refer the Dispute to an independent external dispute resolution body or scheme, such as a relevant state or territory fair trading body or the Australian Competition and Consumer Commission. If no such reference has been made within 60 days of a party receiving a Dispute Notice under clause 13(b), either party may take such action as it considers appropriate.
    5. Nothing in this clause 13 prevents either party from seeking urgent relief from a court or tribunal at any time.
    6. Each party will bear their own costs in relation to the dispute resolution process, unless otherwise agreed.
14. Participation in other sales promotions

    A person is able to participate in this Lake Homes Offers Over Campaign in conjunction with other eligible Serenitas sales promotions.
